Which data protection law applies in Sharjah?

Sharjah has no data protection law of its own, and none of its free zones has a separate regime. Companies across the emirate follow the federal UAE PDPL (Federal Decree-Law No. 45 of 2021), which covers how personal data is collected, used, stored, shared and protected.

Data protection compliance across Sharjah

The same federal law applies everywhere in Sharjah, but what it means day to day depends on the data you hold. These are the businesses we see most.

  • Sharjah city and mainland

Retail, real estate, professional services and family businesses holding customer and employee data.

  • Education

Universities, colleges and private schools holding student, parent and staff records, often including children’s data.

  • Healthcare

Clinics, pharmacies, labs and insurers holding patient data, which is sensitive data under the PDPL.

  • SAIF Zone and Hamriyah

Logistics, trading and industrial companies in SAIF Zone and Hamriyah Free Zone sharing employee, customer and supplier data with group companies abroad.

  • Shams and SRTIP

E-commerce, media and technology companies collecting consent, cookies and user data online.

  • Companies serving EU clients

Businesses already working to the EU GDPR that need to close the differences with the PDPL. See GDPR compliance.

Data Protection Compliance in Sharjah by Intello

Do you need data protection compliance in Sharjah?

You almost certainly do if any of these describe you:

  • You collect customer, patient, student or employee data in Sharjah
  • You run a website or app that collects personal data, uses cookies or sends marketing
  • You hold sensitive data such as health, biometric or children’s data
  • You send personal data to cloud services, vendors or group companies outside the UAE
  • You are a free-zone company and assumed the PDPL did not apply to you
  • A client, partner or bank has asked how you protect personal data

Many Sharjah free-zone companies assume the PDPL is a mainland law. It is not: the PDPL applies in free zones that have no data protection law of their own, which includes every Sharjah free zone.

What PDPL and data protection compliance involves in Sharjah

The UAE PDPL sets out a familiar set of obligations. These are the ones that take the most work.

Lawful basis and consent

A valid basis for each use of personal data. The PDPL relies mainly on consent, with listed exceptions such as performing a contract.

Data subject rights

Processes to handle requests for access, correction, erasure, objection and data portability within the deadlines.

Record of processing

A record of what personal data you hold, why, where it is stored, who receives it and how long you keep it.

Privacy notices

Clear notices on your website, forms and contracts explaining how personal data is used.

Security of processing

Technical and organisational measures matched to the risk, from access control to encryption and backups.

Breach notification

A process to assess breaches and notify the UAE Data Office and affected individuals when required.

Data Protection Officer

A DPO where the law requires one, for example for high-risk processing. The DPO can be internal or outsourced.

Cross-border transfers

Rules for sending personal data outside the UAE, with safeguards where the destination is not adequate.

Frequently asked questions

Does the UAE PDPL apply to Sharjah free-zone companies?

Yes. The PDPL applies in free zones that do not have their own data protection law. No Sharjah free zone has one, so companies in SAIF Zone, Hamriyah, Shams, SRTIP and the other Sharjah free zones follow the federal PDPL, the same as mainland companies.

Is PDPL compliance in Sharjah mandatory now?

Yes. The UAE PDPL has been in force since 2 January 2022. Its Executive Regulations had not been published as of November 2026; once they are, organisations get six months to comply. A full programme takes 8 to 12 weeks, so starting early is the safer path.

Do we need a Data Protection Officer in Sharjah?

You need a DPO where the law requires one, for example for high-risk processing or large volumes of sensitive data. The DPO can be an employee or an external appointee, and many organisations compare outsourced DPO services in Sharjah. We help you decide whether you need one, define the role, and give your DPO the records and processes to do the job.

What are the penalties under the UAE PDPL?

The PDPL leaves the penalties to its Executive Regulations, which had not been published as of November 2026. Until then, the bigger risks for most Sharjah companies are lost contracts, complaints and the cost of a breach handled badly.

How long does data protection compliance take?

A gap assessment takes three to four weeks. Full implementation for a small or mid-sized Sharjah company usually takes 8 to 12 weeks, depending on the number of systems, entities and vendors involved.

We already comply with GDPR. Are we covered?

Partly. The GDPR and the PDPL overlap a lot, but consent and some transfer rules differ. Our gap assessment maps your GDPR programme to the PDPL and closes the differences, so you do not start again.

Are you data protection lawyers?

No. We are data protection consultants, not a law firm. We map your data, fix the processes and technical controls, help you set up the DPO role, and work alongside your legal adviser where you need a formal legal opinion.
